General conditions Building plans

Before ordering the building plans, please agree with the following:

PROPRIETORSHIP OF THE DESIGN:

The design shall at all times remain the property of Dick Zaal Yacht Design 

COPYRIGHT:

The copyright of the building plans shall remain the property of Dick Zaal Yacht Design  No part of these plans may be reproduced in any form, by photostat, microfilm, xerography, or any other means, without first obtaining the written permission of the copyright owner.      Legal duplicate drawings can only be obtained by sending payment to Dick Zaal Yacht design, along with registration- and design number. The contract is subject to the laws of the Netherlands, and any dispute shall be settled either in a legal court of Dutch law or by the Nederlands Arbitrage Instituut (Dutch Arbitration Institute) in Rotterdam, the Netherlands; the choice to be made by Dick Zaal Yacht Design 

BUILDING RIGHTS:

The buyer receives the building plans for the construction of one single yacht and is bound by this contract to see to it that the plans received are used exclusively for one single yacht. The plans shall not be used for any purpose other than the building of the above-mentioned yacht. Permission to build a second yacht using the same building plans can only be obtained by first securing the written consent of Dick Zaal Yacht design  and by payment of  the building rights. Thereafter, Dick Zaal Yacht design  will issue a registration number plate to the buyer. Dick Zaal Yacht Design. retains the right to refuse such permission at their own discretion. The completed yacht may not be exhibited without the written consent of Dick Zaal Yacht Design, nor is the use of the name of Dick Zaal Yacht design  permitted without first obtaining their written consent.

LANGUAGE:

The text on the drawings is in Dutch or in English, according to the buyers choice.

To all our transactions, orders and agreements the Termes and Conditions of the Nederlandse Bond van Jachtarchitecten (NBJA), filed at the Office of the District Court in Haarlem, The Netherlands on 21 February 1968 and most recently amended and registered on 25 May 2005.
